Terms and Conditions

These Terms and Conditions ("Terms") apply to the Pollzy mobile application, Pollzy websites, account tools, support forms, and related services operated by Social Spaces LLC ("Pollzy", "we", "us", "our").

By downloading, installing, creating an account, making a purchase, or using Pollzy, you agree to these Terms. If you do not agree, do not use Pollzy.

1. Eligibility

You must be at least 16 years old to create or use a Pollzy account.

By using Pollzy, you represent that you meet this requirement and have the legal capacity to agree to these Terms. If you are old enough to use Pollzy but not old enough to enter into a binding contract where you live, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

2. Account Responsibilities

You agree to:

• Provide accurate account information.
• Keep your login credentials confidential.
• Be responsible for activity under your account.
• Keep your contact, payment, and account recovery information current.
• Notify us promptly at hello@pollzy.app if you suspect unauthorized access.

We may suspend, restrict, or terminate accounts involved in abuse, fraud, payment issues, security risks, or policy violations.

3. License and Intellectual Property

Pollzy grants you a limited, revocable, non-exclusive, non-transferable license to use Pollzy for personal, non-commercial use.

All rights, title, and interest in Pollzy, the brand, software, designs, features, data models, and related intellectual property remain with Social Spaces LLC and its licensors.

You may not:

• Copy, modify, reverse engineer, decompile, or create derivative works from Pollzy.
• Circumvent security, payment, entitlement, moderation, or access controls.
• Scrape, crawl, harvest, or extract Pollzy data except as allowed by law.
• Use Pollzy branding in a misleading or unauthorized way.
• Resell, sublicense, rent, or commercially exploit Pollzy or your account.

4. User Content

You retain ownership of content you post or upload, such as polls, images, comments, direct messages, support chat messages and attachments, message reactions, profile content, reports, and bug reports.

You grant Pollzy a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify for formatting or moderation, display, distribute, analyze, create technical derivatives from, and otherwise use your content as needed to operate, secure, improve, promote, and provide Pollzy. This license includes the right to show your content to other users, use it in feeds, chats, notifications, recommendations, search, profile pages, moderation queues, support workflows, and promotional surfaces related to Pollzy.

You represent that you have all rights needed to post your content and grant this license. You are responsible for your content and for any consequences of posting it.

Deleting content or deleting your account does not remove copies already viewed, copied, screenshotted, cached, backed up, shared, or retained for moderation, safety, legal, or audit purposes.

5. Acceptable Use

You must not:

• Post unlawful, abusive, hateful, sexually explicit, exploitative, violent, threatening, harassing, defamatory, deceptive, or infringing content.
• Post, solicit, promote, or facilitate child sexual abuse material, sexual exploitation of minors, grooming, or any content that endangers children.
• Harass, impersonate, threaten, dox, shame, exploit, or target others.
• Send unwanted, abusive, threatening, sexually explicit, exploitative, deceptive, or spam messages.
• Manipulate votes, follows, reports, recommendations, rankings, boosts, rewards, subscriptions, or engagement systems.
• Use bots, scripts, fake accounts, automation abuse, scraping, spam, or coordinated inauthentic behavior.
• Attempt unauthorized access, probe security controls, overload the service, interfere with other users, or disrupt Pollzy infrastructure.
• Upload or send malware, unsafe links, malicious links, or content designed to compromise devices, accounts, or systems.
• Use Pollzy for illegal activity, fraud, unauthorized advertising, or commercial solicitation without our permission.

Use of Pollzy is also subject to our Community Guidelines. We may consider context, severity, repeat behavior, and risk to users or the platform when applying these rules.

6. Moderation and Enforcement

Pollzy may investigate reports and take action including warnings, content removal, visibility reduction, boost removal, purchase or reward reversal, temporary restrictions, account suspension, account termination, and referral to authorities where appropriate.

Moderation decisions are made in good faith to protect user safety and platform integrity. We do not guarantee that every piece of content will be reviewed, removed, or preserved. Automated tools, human review, and third-party moderation services may be used to help evaluate content.

Submitting knowingly false, abusive, or spam reports may result in enforcement action.

7. Social Features, Direct Messages, Vibe Checks, and Recommendations

Pollzy includes social, direct messaging, ranking, vibe-check, friend-discovery, recommendation, notification, analytics, and similar features. These features are for entertainment, discovery, and social interaction only.

Direct messages may include active chats, message requests, poll shares, reactions, read receipts, typing indicators, online status, link safety checks, chat notifications, support chats, support attachment requests, and controls to mute, hide, delete, report, block, edit, or unsend messages where available. Pollzy may limit, filter, block, scan, or reject messages, attachments, or links to reduce spam, abuse, fraud, malware, unsafe links, harassment, and other policy violations.

Message requests may require recipient acceptance before a conversation becomes active. Pollzy may limit how many pending request messages can be sent, apply rate limits, and prevent messaging where users have blocked each other or disabled message requests.

Hiding or deleting a chat affects your own inbox and visible history. It does not guarantee deletion from the other participant's account, reports, moderation queues, logs, backups, legal/safety records, or already-delivered notifications. Unsending or editing a message may not remove copies already seen, copied, screenshotted, reported, cached, or retained for safety or legal reasons.

Pollzy Support chats are provided for support and account/service issue handling. Pollzy administrators may start, review, update, resolve, and reopen support ticket conversations; use saved response templates; request image or video attachments; and remove attachments when a ticket or related issue is resolved. You are responsible for the content you submit in support chats and attachments, and you should not upload sensitive information unless it is necessary for the support request.

Vote visibility controls may hide your vote from certain profile or voter-list surfaces, or show you as anonymous in some views. They do not delete your vote, change poll totals, make the vote unavailable to Pollzy systems, or guarantee anonymity in every context, such as safety, moderation, legal, backup, analytics, recommendation, Vibe Check, or Vibe Insights processing.

Pollzy does not guarantee that poll results, vibe checks, compatibility indicators, rankings, recommendations, analytics, or boost metrics are complete, accurate, representative, or suitable for any particular decision. They are not professional, medical, mental health, financial, legal, educational, employment, or relationship advice.

Feature availability, limits, ranking logic, search behavior, notification routing, policy-update notices, boost duration, recommendations, ad availability, and other product details may change over time.

8. Identity Verification and Verified Badges

Pollzy may offer optional identity verification or verified-badge features. These features may require you to provide profile information, a profile photo, date of birth, and identity information through Stripe Identity or another supported provider.

Verification is not guaranteed. Pollzy may review identity-verification results, profile information, profile photos, username choices, impersonation risk, safety signals, and policy history before granting or keeping a verified badge. We may reject, revoke, pause, or require reverification for a verified badge if information cannot be validated, if profile details change, if fraud or impersonation risk is detected, if provider checks fail, or if your account violates these Terms or our Community Guidelines.

Verified badges do not imply endorsement, employment, sponsorship, official status, or that all information about a user is accurate. Verification requirements, retry limits, review timing, badge availability, and verification providers may change over time.

9. Third-Party Services

Pollzy relies on third-party services, including:

• Firebase and Google Cloud services, including Authentication, Firestore, Storage, Cloud Functions, Realtime Database, Analytics, Crashlytics, and Remote Config.
• Google Play Services, Google sign-in, Google Analytics, and Google AdMob.
• Google Web Risk or related Google security services for chat-link safety checks where enabled.
• Apple sign-in, App Store purchases, and Apple platform services.
• Expo services, including Expo Notifications.
• RevenueCat for subscriptions, purchases, purchase validation, entitlements, and customer identifiers.
• Stripe Identity for identity verification, verified-badge checks, verification session handling, and related identity-review outputs.
• OpenAI API services for content and image moderation, poll classification, discovery metadata, recommendations, and Vibe Insights support.
• GitHub workflows for bug-report triage and engineering support.

Your use of those services may be subject to their own terms, privacy policies, platform rules, and availability limits. Pollzy is not responsible for third-party service outages, billing systems, policy changes, moderation decisions, or platform requirements.

10. Subscriptions, Boosts, Ads, and Purchases

Pollzy may offer free features, ad-supported features, rewarded ads, subscriptions, consumable boost packs, promotional grants, and other paid or monetized features.

Pollzy+ subscriptions

• Pollzy+ may be offered as an auto-renewing monthly or annual subscription through Apple App Store, Google Play, or other supported app-store billing systems.
• Pricing, renewal period, free-trial details if any, taxes, and included features are shown before purchase in the app or app-store purchase sheet.
• Your subscription renews automatically unless canceled at least 24 hours before the end of the current billing period, or within the deadline required by the applicable app store.
• You can manage or cancel your subscription through your Apple App Store or Google Play account settings. Deleting your Pollzy account or uninstalling the app does not automatically cancel a subscription.
• Access to Pollzy+ may end if your subscription expires, is canceled, is refunded, is charged back, cannot be validated, or violates these Terms.
• Pollzy+ features, limits, bonus boosts, and availability may change, but we will not intentionally remove material paid benefits from an active paid period without a reasonable replacement, credit, or other remedy where required by law.

Boost packs and boost features

• Boost packs are consumable digital items that may increase the visibility or distribution of eligible polls for the boost duration shown in the app.
• Boosts do not guarantee impressions, votes, follows, engagement, revenue, ranking placement, popularity, or any specific result.
• Boosts have no cash value, are not transferable, may not be resold, and may be revoked or adjusted for fraud, abuse, refunds, chargebacks, technical errors, or policy violations.
• If a boost fails because of an error under Pollzy's control, our remedy may be to restore the boost, grant a replacement boost, or provide another remedy required by law.

Ads and rewards

• Pollzy may display ads, including rewarded ads and native ads. Ads may be personalized or non-personalized depending on your settings, consent, device settings, and provider availability.
• You can turn off Pollzy's ad personalization requests in Settings > Ads. Turning this off does not remove ads and does not guarantee that every ad will be non-targeted under each provider's systems, but Pollzy will request non-personalized AdMob ads where supported.
• Rewarded ads, ad inventory, and reward delivery are not guaranteed. Rewards may require completing the ad experience and may be denied, reversed, or limited for fraud, abuse, technical errors, or policy violations.

Billing, refunds, and taxes

• Purchases are processed by the applicable app store or payment provider. Their terms govern payment authorization, billing, cancellation mechanics, family sharing where applicable, taxes, refunds, and chargebacks.
• Refund requests should be directed to the app store or payment provider that processed the purchase, unless the provider directs you to Pollzy.
• We may correct purchase, entitlement, boost, and pricing errors, including by revoking incorrectly granted benefits or granting replacement benefits where appropriate.

11. App Store Terms

If you downloaded Pollzy through Apple App Store or Google Play, your use of Pollzy is also subject to the applicable store terms and rules.

Apple, Google, and their subsidiaries are not responsible for Pollzy support, maintenance, content, claims, or liabilities, except as required by applicable platform terms or law. To the extent required by Apple's terms, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Privacy

Your use of Pollzy is also governed by the Privacy Policy:

13. Termination

You may stop using Pollzy at any time and may delete your account in-app.

We may suspend, restrict, or terminate access at any time for violations of these Terms, Community Guidelines, legal requirements, payment issues, fraud, security risks, or conduct that may harm users, Pollzy, or third parties.

Termination may result in loss of access to your account, content, Pollzy+ features, boosts, rewards, settings, and other app features. Sections that by nature should survive termination, including licenses, disclaimers, limitations of liability, indemnification, payment terms, and dispute terms, will survive.

14. Disclaimer of Warranties

Pollzy is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability, security, or uninterrupted operation, to the maximum extent permitted by law.

Pollzy does not warrant that content will be accurate, safe, available, or error-free, that moderation will identify every violation, that boosts or ads will produce any specific outcome, or that data loss will never occur.

15. Limitation of Liability

To the maximum extent permitted by law, Social Spaces LLC and its affiliates, officers, employees, contractors, licensors, and service providers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of data, profits, goodwill, reputation, content, purchases, rewards, or business interruption arising from or related to your use of Pollzy.

Our aggregate liability for claims relating to Pollzy will not exceed the greater of (a) USD $100 or (b) the amount you paid us for Pollzy in the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless Social Spaces LLC and its affiliates, officers, employees, contractors, licensors, and service providers from claims, liabilities, losses, damages, and expenses, including reasonable legal fees, arising from your content, your misuse of Pollzy, your purchases or chargebacks, your violation of these Terms, your violation of law, or your violation of another person's rights.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of Washington and applicable United States federal law, without regard to conflict-of-law rules.

You and Pollzy agree that disputes will be resolved exclusively in the state or federal courts located in Washington, unless mandatory law requires a different forum. You and Pollzy consent to personal jurisdiction and venue in those courts.

Before filing a claim, you agree to contact us at hello@pollzy.app and give us a reasonable opportunity to resolve the dispute informally, unless doing so would be legally prohibited or impractical.

18. Changes to Terms

We may update these Terms from time to time. We will post the updated version and revise the "Last updated" date. Continued use of Pollzy after updates means you accept the revised Terms, except where additional notice or consent is required by law.
